First Pradaxa Lawsuits Have Now Been Filed

News reports and government reports have now confirmed that in the first year of Pradaxa's approved use in the United States, at least 260 patients have died from bleeding events where Pradaxa blocked the body's natural blood clotting defense. Three of those patients have now filed Pradaxa product liability lawsuits in federal courts.
These Pradaxa lawsuits, filed by a law firm not affiliated with Powers Taylor, mark the start of what will most assuredly be a landslide of similar lawsuits. If Pradaxa's continues to be prescribed in the same numbers, and if these serious and fatal injuries continue at the same rate, Powers Taylor expects that the number of lawsuits will grow exponentially. The Reasons Why Greece Should Leave The Eurozone And Return To The Drachma

The benefits of Greece regaining control of its currency, such as increased competitiveness, would outweigh the costs of leaving the eurozone and defaulting on its debt. A euro exit will be hard but watching the slow disorderly implosion of the Greek economy and society will be much worse.

The austerity measures that are being forced upon the country in exchange for more bailout money from the European financial authorities are setting it up for decades of pain. Greece will have 25-50 years of austerity and poverty, all this to remain in the eurozone where they hopelessly cannot compete. If they can't compete why would they stay in the eurozone? It is all about Greek leadership and its connection to bureaucrats, bankers and others that demand their inclusion into European and World government.

The Greek bailout and debt deal agreed by European Finance Ministers is a farce, a program designed to pay Greece's international creditors and buy time.

The reasoning is simple: the financial sector is trying to keep alive the illusion that Greece isn't bankrupt, cleverly manipulating the fear that a Greek bankruptcy would trigger a fatal chain reaction in order to get paid. If a default was declared, the resulting payouts would start a chain reaction that would cause widespread worldwide bank failures, making the Lehman collapse look small by comparison.

Greece is indeed broke, and the reason why all the bailout money being thrown into the pot isn't being used to foster competitiveness and help the country get back on its feet is because this bailout isn't actually going to fix Greece: rather, it's all about preserving the dream of a pan European nation state and outside financial interests.

By bailing out Greece and the foreign bank holders of sovereign debt, the pan European political dream remains intact. Current and future actions, therefore, are designed to simply buy more time to preserve the political dream of a future United States of Europe and all the benefits this entails.

The Greek bailout keeps the money flowing into the European financial system. Money is lent from European institutions - ultimately tax payer's money - and then flows into the coffers of European banks. It is a bank bailout on a gigantic scale.

But the good news for the banks doesn't end there. By forcing Greece to speed up its privatisation programme, all sorts of goodies - from airports, ports and motorways to water and sewerage systems - will come up for sale to be snatched up by the financiers of the countries imposing the policies.

The bailouts, the severe public spending cuts, the onslaught on public ownership - all reflect the experience of the developing world in the 1980s and 1990s. The result was two lost decades of development.

Up until this point it was unusual for countries to go backwards in terms of their income levels. But during the 1990s 54 countries went backwards in terms of per capita income and the level of extreme poverty increased by 100 million - not because of war or natural disaster but debt and structural adjustment.

Human welfare was sacrificed to the diktats of the financial system. The increased rates of murder, suicide and HIV in Greece today paint a similar picture.

There are alternatives which Europe could learn from such as what happened in Latin America. The economic policies pushed on Latin America in the early 1980s were an excellent way of helping U.S. banks out of crisis, but an appalling way of resolving Latin America's debt crisis, instead creating two decades of more debt, poverty and inequality.

Of course, this was the precise purpose of these policies - to shift the burden of financial crisis from the financial system and onto developing nations.

The International Monetary Fund (IMF) and World Bank lent money to dozens of countries which would otherwise have defaulted, in order to keep the debt repayments flowing back to the banks of the rich world that had created the crisis by their own reckless strategies.

Then, those countries, which didn't benefit at all from these bailout funds, were told to implement structural adjustment policies which saw industry privatised, money freed from government control and markets ripped open to competition with well-subsidised companies from the U.S. and Europe. Poverty boomed, inequality soared and finance was proclaimed king.

The same logic lies barely concealed behind the Greek bailout agreed by European finance ministers. There is not even a pretence that Greece's people will benefit from these funds.

Make no mistake the austerity measures being forced upon the people of Greece by the IMF and European Central Bank (ECB) are for the benefit of the banks, financial institutions and corporate elite.

The slashing of pensions and the minimum wage, the large reduction in public sector spending and job losses, can only make the depression longer and deeper. Even the Credit Ratings Agencies have recognised the futility of forcing countries into ongoing stagnation.

Greece is stuck in a vicious cycle of insolvency, low competitiveness and ever-deepening depression. Exacerbated by a draconian fiscal austerity, its public debt is heading towards 200 per cent of gross domestic product. To escape, Greece must now begin an orderly default, voluntarily exit the eurozone and return to the drachma.

The exit from the eurozone should be in the long-term interests of working people, not big business or banks. Contrary to what is often asserted, Greece would not collapse if it quit the euro. After all, monetary unions have a limited shelf life, and Europe's is a particularly badly structured one. Exit is the most sensible way for Greece to restore competitiveness and start to recover. The alternative is to continue with austerity packages that do not work and will lead to long-term decline.

The irony of the whole situation is that the austerity measures imposed by the EU-ECB-IMF troika are the main contributing factor to pushing Greece into a deep depression.

If Greece defaults, the country gets immediate relief from the crushing interest payments on its debt, leaving it with a relatively modest primary deficit which excludes the big interest payments Greece is faced with now.

In such a scenario, the pressure for austerity would therefore diminish. This would allow Greece to choose policies that encourage growth, rather than ones that shrink the deficit but retard growth by imposing higher taxes.

By abandoning the euro and adopting a properly valued currency, Greece can restore its international competitiveness. This means greater employment demand from both domestic and foreign sources. A new drachma would boost Greece's competitiveness almost overnight.

The potential negative of default is that Greece will likely lose access, for a while, to international credit markets (although it will be a much safer investment after default than it is now). Another significant problem would be capital losses for core eurozone financial institutions. Overnight, the foreign euro liabilities of Greece's government, banks and businesses would surge. Yet these problems can be overcome. Argentina did so in 2001, when it 'pesified' its dollar debts.

It seems the main issue for Greece is just how long it's going to have to suffer. The harsh austerity measures demanded by the EU and IMF make an economic recovery in this debt-crippled nation a near impossibility over the next two decades.

A country like Greece even with a 70% debt write off, and staying in the euro, will live in poverty for the next 25 to 50 years. A full default and exit from the euro would leave them with a 5 to 10 year depression. At first the latter will be disastrous but then austere normality will occur.

Greece should stop trying to save the euro and work on preserving democracy, regaining its independence, and reforming its own welfare state - all arguably more important than a currency union. Use a new drachma to transform the economy and create true gains to GDP.

If Greece continues to be engaged in what looks like a never-ending game of 'extend and pretend' then the long-term forecast is very bleak indeed.

It doesn't concern powerful elite that the debt of Greece is unpayable, as they are not paying for the bill anyway, you are. Money often flows between global interests, high above the heads of the citizens who most often end up having to pay it back.

When debt cannot be paid we need to stop punishing the people least responsible and start looking at changing the rules governing those who are responsible. This includes the small group of elected and non-elected leaders, composed of ruling Greek families and elites, making decisions for their own personal political and financial gain. The Venizelos elite have shown itself to be without ethics or remorse in many ways already (i.e. the Venizelos government secretly removed 70% of major hospital, utility and university account funds to pay foreign bondholders).

If only Greece had a leader like Rafael Correa of Ecuador, the country would then stand up to the ECB and the IMF because he knows they are nothing more than loan sharks on a huge scale. He would overturn the neoliberal policies currently being implemented in Greece with policies more sensitive to social justice, saving the people from having to pay for a loan that didn't benefit them.

The engagement of Greek people in the issues outlined above is fundamental - not only to help resolve the financial crisis but also in the fight against corruption. Corruption is seriously undermining the integrity of the Greek state and at the highest level can lead to very costly mistakes.

Nothing highlights this more than how Goldman Sachs helped Greece set up a secret loan swap deal in 2001 that helped the country hide its debt levels in order to meet requirements to join the European Union.

The deal is a story of two sinners because of the intentions of the two parties involved - Greece was trying to cover up its high debt levels and Goldman Sachs was trying to make a profit.

And what a profit Goldman Sachs made - on the day the 2001 deal was struck the Greek government already owed the bank about 600 million Euros more than the 2.8 billion Euros it borrowed. By 2005, the price of the transaction, a derivative that disguised the loan and that Goldman Sachs persuaded Greece not to test with competitors, had almost doubled to 5.1 billion Euros.

Greece is just another example of a poorly governed client that got taken apart by a multinational investment bank. Goldman Sachs is ruthless about ensuring that its interests aren't compromised - it's part of the DNA of that organization.

For the reasons outlined above I urge all Greeks to continue their fight against the policies of the EU-ECB-IMF troika and regain their sovereignty from the whims of an unstable and unethical financial system.

Many people (particularly outsiders) blame all Greece's troubles on its problems with corruption, tax evasion and its oversized state sector. Yet, there is one area of the Greek economy that lies at the heart of the crisis and radically needs reform: military spending.

The fact that Greece, a relatively small and democratic country should spend as much on its military as it does is perplexing. In 2006, as the financial crisis was looming, Greece was the third biggest arms importer after China and India. And over the past 10 years its military budget has stood at an average of 4% of GDP, more than 1000 Euros per person. So why has Greece continued to spend such huge amounts on its army? One major factor is that France and Germany's arms industries have greatly profited from this profligate military spending, leading their governments to put pressure on Greece not to cancel lucrative arms deals.

In the five years up to 2010, Greece purchased more of Germany's arms exports than any other country, buying 15% of its weapons. Over the same period, Greece was the third-largest customer for France's military exports and its top buyer in Europe. Significantly, when the first bailout package was being negotiated in 2010, Greece spent 7.1bn euros on its military, up from 6.24bn euros in 2007. A total of 1bn was spent on French and German weapons, plunging the country even further into debt in the same year that social spending was cut by 1.8bn euros. It has been claimed by some that this was no coincidence, and that the EU bailout was explicitly tied to burgeoning arms deals. In particular, there is alleged to have been concerted pressure from France to buy several stealth frigates. Meanwhile Germany sold 223 howitzers and completed a controversial deal on faulty submarines, leading to an investigation into accusations of bribes being given to Greek officials.

Amid economic stagnation in Europe and the west, military technology remains one of the key areas in which competitive advantage has been maintained over emerging economies. However, while this growth has benefited major arms-exporting countries such as Germany, France and the UK, it has deepened even further the economic divide within Europe. Interestingly, Portugal - another country currently in the news for its economic woes - is Germany's second largest arms buyer after Greece.

If Greece is in need of structural reform, then its oversized military would seem the most logical place to start. In fact, if it had only spent the EU average of 1.7% over the last 20 years, it would have saved a total of 52% of its GDP - meaning instead of being completely bankrupt it would be among the more typical countries struggling with the recession.

And the Greek people, instead of facing austerity measures that have reduced living standards by 30%, might have been able to take a more moderate and sustainable route to reform.

A Short History On Confederate Money

In 1860, Christopher G. Memminger was given the task to organize the Confederate treasury. Memminger was born in Germany on January 9, 1803 and his mother and grandparents immigrated to Charleston, SC shortly after his father's death. Memminger was eventually adopted by the future governor of SC, Thomas Bennett.

After studying law, Memminger entered politics and became a member of the SC state legislature in 1836. He was responsible for writing the Constitution of the Confederate States of America as a member of the Confederate Provincial Congress. Memminger became Secretary of the CSA Treasury on Feb 21, 1861 but resigned on July 18, 1864 amid criticism for the CSA's deteriorating economy.

When the Confederacy occupied the federal mints at New Orleans, LA, Dahlonega, GA,and Charlotte, NC they discovered these facilities didn't have enough bullion to mint coins. They attempted to issue a half-dollar coin and produced four prototypes. Bowhunting Deer: Pre-rut Whitetail Strategies

The temperatures at night start to graze the bottom of the mercury barrel. The amount of available sunlight decreases on a daily basis, and whitetail bucks slowly go mad with wanton desire. Rubs and scrapes appear on the edges of fields and along trails in high-interaction areas. Deer activity intensifies during daylight hours as a sudden influx of animals crossing highways and country roads at night increases. This stage of the whitetail breeding season is commonly referred to as the pre-rut.

Selecting the right stand location at this time of year can result in a close encounter of the monster buck kind. It's an extremely exciting time to be in the deer woods. There simply is no better time to identify, isolate and exploit the common behavioral traits of mature whitetails bucks than during the pre-rut.

Although the timing of the rut fluctuates across North America -- the farther one travels south, the later the rut occurs -- the tactics described here will work throughout the entire range of the white-tailed deer.

We all know what happens during the rut. Bucks are running around like wild dogs in a helter-skelter manner, chasing every hot doe that crosses their path for miles. Continuously monitoring and scouting various trail systems can lead to areas that big bucks prefer to roam. Virtually living solitary lives for most of the year, big whitetails often select the nastiest, most impenetrable piece of real estate in an area to call home. These areas are normally located in sections of timber where deer feel safe.

Cedar swamps, standing cornfields, briar thickets, brush-choked streambeds and pine plantations are all areas that offer protection and provide concealed daytime movement. For this reason, bucks will often establish their bedding areas -- or core areas -- nearby. Mature animals will routinely use this type of cover to move from one section of the woods to another.

Although bucks tend to let down their guard during the heat of the rut, safety is still their No. 1 concern throughout the pre-rut period. The odds of arrowing trophy deer are excellent in places where they feel secure. Identifying and studying these areas will earn you the opportunity to harvest a true wall hanger.

Setting up over trails that link feeding and bedding areas can still produce good results. Bucks will continue to use early-season trails, making short visits at food plots and crop fields as they slowly extend their range into neighboring territory. These excursions focus on assessing the breeding status of local doe concentrations, and storing energy for the rigors of the upcoming rut by quickly consuming high-energy chow.

In most cases, trophy bucks choose to travel on less-defined trails that skirt heavy cover. Rarely will you see a mature deer traveling through open timber or crossing an open field at this time. Keeping a low profile is standard operating procedure, but the one weakness bucks have in sustaining an anonymous lifestyle is the uncontrollable habit of leaving behind evidence of their existence. Accurately interpreting and processing this information can be a tremendous aid in devising a plan of attack.

Solving The Puzzle

The most difficult aspect of hunting trophy whitetails is interpreting deer sign. Developing this skill will take time and experience. By using a little creativity you can learn to evaluate and eventually exploit the sign that bucks yield in the wake of their travels.

Imagine interpreting and processing deer sign as constructing a giant jigsaw puzzle. The wooded terrain and natural food sources of a certain area make up the main body and outer edges of the puzzle. The final pieces include rubs, scrapes, trails and bedding areas. Normally the edges of a puzzle are the easiest to identify and arrange. The task becomes more challenging and reveals more of the impending scene as you work towards the center. Gathering bits of information and applying the acquired knowledge will lead to a specific strategy for solving the puzzle. In one case it may be a beautiful mountain vista or prominent landmark. In the other, a trophy buck.

I personally focus my attention on finding fresh rubs while on scouting forays. Rubs are one of the few distinguishing pieces of evidence that verifies antlered animals are frequenting a certain locale. From the time their antlers harden in early September until they cast them in late winter bucks will make rubs. Saplings, fence posts, power line poles and a wide variety of scrub brush fall victim to their abuse. Taking advantage of a buck's natural tendency to create these spontaneous woodland sculptures is the answer to consistently taking bragging-size bucks during the pre-rut.

Scrapes are also an indication that bucks are working an area. Studies have shown that the majority of activity in and around a scrape generally occurs under the cover of darkness. Yearlings and immature bucks will visit scrapes on a regular basis, but mature animals tend to shy away from these locations during daylight hours. For this reason, rubs normally offer a more reliable means of plotting travel patterns than scrapes.

However, during a recent hunt in northern Missouri, I witnessed several large bucks visiting a primary scrape at various times of the day, including the first hours of daylight in the morning and the last few hours before sunset in late afternoon. One of the aforementioned bucks sported a massive, bone-white set of antlers whose rack would score somewhere in the high 160s as a 10-point typical. I had definite plans of harvesting this particular animal, but due to a perplexing attack of impatience I wound up shooting a lesser deer only to have the big 10 show up under my stand moments after harvesting the smaller buck.

In this case, I learned that there are simply no absolutes when it comes to bowhunting trophy whitetails. Anything can happen at anytime. An example of this -- as stated previously -- are the many studies that substantiate the frequency of nighttime scraping activity by mature deer. Yet those north Missouri bucks were brazenly working their scrapes during broad daylight without a care in the world.

So when pursuing trophy bucks with archery equipment it's best to keep an open mind for every possible opportunity to be able to capitalize on the habits of the deer in your particular area. This type of mindset is yet another key to outwitting pre-rut whitetails.

Search and Enjoy

One of the most productive times to search for deer sign is immediately following the bow season. Another is during the spring. In the early stages of spring, the woods appear in basically the same condition as they did during the previous bow season. Rubs, scrapes and trails are exposed and are easily identifiable. This time of the year also offers yet another opportunity to legally harvest the prized headgear of virtually every buck in your hunting area. This highly enjoyable, early spring activity I'm referring to is widely known in the bowhunting ranks as shed hunting.

Hunting for shed antlers has become one of the fastest growing pastimes of an ever-increasing number of outdoor enthusiasts. Serious bowhunters, nature lovers and those who seek to profit from these complimentary woodland souvenirs are among the most recognized of today's burgeoning legion of bone collectors. With a formal record book in current production that is solely dedicated to shed antlers, and a separate category that officially recognizes them as stand-alone trophies, the one-time leisure pursuit of a few adventurous individuals has now become an extremely competitive arena.

Scouring the woods for these naturally abandoned gems of the whitetail world definitely has its advantages for archers seeking trophy bucks. Finding a single shed -- or if you're lucky enough -- a matched set of antlers will positively confirm that a certain buck has survived the hunting season. Also, simply knowing that a particular buck is still alive and well, and is residing in your hunting area on a consistent basis, will significantly increase your odds of killing him next bow season. Yet another reward for your efforts is the beautiful addition that shed antlers make to any trophy room. Attached to the skull plate or displayed on a mantle or laid out on deer hide covered coffee table makes no difference to me. Antlers are eye-popping works of art that are just plain cool.

Unfortunately, the exploration of every hunting spot prior to the season is not possible, leaving many pieces of the whitetail puzzle missing or out of place. In this case, you must switch gears and start to look at things from a different perspective. Scouting just prior to, or during the open season, is tricky business. One wrong move could ruin a spot for the entire year. Yet there is a way to get the drop on the resident deer herd with only marginal amounts of disturbance.

Rubs made the previous fall are the keys to locating hot spots in unfamiliar territory. Fresh rubs are much better, but one of the easiest ways to pinpoint productive stand sites in a new area or when the season is fast approaching is by tracking down old rubs. Old rubs provide valuable clues to unlocking preferred travel corridors. The logic behind this method relies on the habitual nature of deer. A spot that held bucks in the past will usually hold them in the future if the deer still feel secure while moving through the area.

Stand Placement

The location of rubs is more important than their size. A big rub is a relatively accurate measure of the quality of animal you are pursuing. On the other hand, big rubs can only tell you where a good buck was, not where he is going to be on a regular basis. Rubbing activity normally takes place under the cover of darkness along field edges. Bucks often stop and make rubs when exiting a field in the morning. Although the eye-catching fallout from these late-night calisthenics can be very impressive, don't bank on seeing the buck during daylight hours at the edge of the field.

Prime locations are easily identifiable, but not as easy to find. It will take a fair amount of dedication and legwork to uncover areas where big bucks spend the majority of their time. Relying on rubs will eventually lead to the center of a buck's bedroom. Bucks tend to mark the perimeter of their bedding areas with rubs. There will usually be a line of rubs leading into and another line leading away from a bedding area. Concentrate on clusters of rubs adjacent to heavy cover or a line of rubs leading into similar terrain. Setting up within close proximity of the trail, or trails, that link these rubs can lead to a close range shot at a good deer.

Be thoroughly discriminate in the process of stand selection. Set up 15 to 20 yards from the edge of the trail or line/cluster of rubs. Choose a tree that takes advantage of the prevailing wind direction. Make sure the thermals will blow your scent away from the deer and their expected route of travel. Place the stand in a spot that allows immature and non-antlered specimens of your quarry to pass by without detecting your presence. The goal is to catch the buck on his feet during legal shooting hours. To increase your odds of success, place a stand as close to the buck's bedding area as possible without tipping your hand. Couple the location with fresh rut sign and sit tight.

To maintain a productive stand site, consider the following advice: Make sure to alter your entry and exit routes to and from your stand to keep the deer guessing. Try and keep noise to a bear minimum while in close proximity of the ambush site. Take every precaution necessary to avoid contaminating the area with human scent. Wash all hunting clothes in baking soda, or similar agent, and apply scent-eliminating sprays. Don't over-hunt the stand or allow the deer to pattern your movements. Avoid touching low-hanging branches or saplings to reduce the risk of dispensing alarming odor on surrounding vegetation. Those are literally, in many cases, the headline and the body of the ad. After that, you simply would put a phone number, your phone number if you want, or your voicemail recorded phone number with box. You might say, "1-800 blah, blah, extension 105," and/or you could put your website.

Typically I would put the phone number with the extension and the website. That gives the person two options to respond. I think that's enough. If they're interested, they'll clearly figure it out. If they're computer savvy, they might go to the computer. If they just want to reach out to you, if there's a real sense of urgency, typically they're going to call.

I will put this piece of paper with about 30 different ads that I've used on the website so you've got that. Also, as part of this, I'm going to upload a one-page sheet of paper that I used many, many times. It's kind of my cheat sheet for how to develop headlines, powerful headlines, how to use words in the headlines that are powerful.

There are 10 words that you should all know that are a part of your headline. On this sheet are those 10 words. You need to incorporate those into your headlines. There are about a dozen or so what I call "headline starters." I'll just read those off to you. This is the way you would start your headline in terms of newspaper ads or some of the other things we'll be doing.

Headline starters include:

- Announcing - How-to...
- 17 ways to... (could be 3 ways, 5 ways...)
- An amazing...
- A little secret...
- The secret of...
- At last..
- Now....
- Now at last... (put the two together)
- Here... (you're going to combine another one) -
- Here are 17 ways to...
- The art of...
- The startling fact about...
- New... (new is always a very good headline)

Particularly in a newspaper ad, where you don't have a lot of space, you have to have a very powerful headline. Again, always test. If you put your newspaper ad out there and you don't get any calls the first couple of weeks, it's one of two things.

One, it's the wrong newspaper. The way to figure that out is, are there other real estate investors advertising in that paper? If there are other real estate investors advertising in the paper, it's a good indication that's it probably working. If you're the only real estate investor in that paper, maybe it's an indication for whatever reason that paper is not going to cater to potential sellers.

Obviously, think that through a little bit. Use these various tools that I'm giving you in terms of crafting your headlines to make sure they've very powerful. Again, test, test and test.

What is an Injured Spouse and what is the Relief the IRS Provides?

For federal tax purposes, an Injured Spouse is someone that is denied a tax overpayment refund or a portion of a refund because the funds were applied to off-set a past-due obligation of a spouse or ex-spouse. This obligation can be a past-due federal tax, state income tax, child or spousal support or even a federal non-tax debt, such as a student loan. In this case, the spouse is injured because they do not have a legal obligation to the past-due amount but by having their overpayment applied to the liability, the IRS is in fact holding the person responsible for the debt.

As a remedy to holding a non-liable person responsible for the federal debts of their spouse or non-spouse, the IRS offers Injured Spouse Relief. To avoid having a refund withheld, a taxpayer can request Injured Spouse Relief at the time they file their tax return. If approved, the injured spouse will not be held responsible for their spouse's federal tax debts, state tax liabilities, etc. The IRS will also determine the amount of tax owed by or overpayment due to each spouse.

Thus, an injured spouse may be able to recover their loss (misapplied refund) should the IRS approve the taxpayer's claim for relief. According to the IRS, in order to qualify for Injured Spouse Relief, a taxpayer must meet the following three conditions:

1. You must not be legally obligated to pay your spouse's past due tax liability.

2. You must report income such as wages, taxable interest, etc., on the joint return.

3. You must have made and reported payments, such as federal income tax withheld from your wages or estimated tax payments, or you claimed the earned income credit or other refundable credit, on the joint return.

Most Americans will need to meet all three of the qualifications to be deemed an injured spouse.

However, if you live in a community property state (Arizona, California, Idaho, Louisiana, New Mexico, Nevada, Texas, Washington, or Wisconsin) then you will only need to meet the first qualification. In community property states, over-payments are considered joint property and are generally applied (offset) to legally owed past-due obligations of either spouse. Please note that there are exceptions. The IRS will use each state's rules to determine the amount, if any, that should be refunded to the injured spouse. Under state community property laws, 50% of a joint overpayment (except the earned income credit) is applied to non-federal tax debts such as child or spousal support, student loans, or state income tax. However, state laws differ on the amount of a joint overpayment that can be applied to a federal tax debt. If you believe you are an injured spouse but live in a community property state, you should seek the help of a professional.

Once you have determined the IRS has, or will, withhold a refund because of your spouse's past due taxes, you should print out a copy of IRS Form 8379. You will then need to allocate income, adjustments, deductions, and credits between you and your spouse in Part 2 of the form. After completing the form, you can mail it to the IRS with your tax return, or if you have already filed your return, then you can just mail it to the IRS. For those of you who e-file your return, you can even include Form 8379.

Unfortunately, qualifying for Injured Spouse Relief is not as easy as it may seem.
